MORE INFO: On October 9, 2001, I leased to man (contact owner for name) of New Haven, Vermont my then 22 year old Quarter Horse mare named Nitemare. He signed a lease, which stated if the horse were to become sick or have problems, he was to call me so that I could make a decision on what to do for her, etc.
Throughout the years, I kept in constant touch with lessee, drove over to visit her, and she seemed to be well taken care of. When I returned from our vacation in March of 2006, I called lessee, who had free leased Nitemare, to see how she was doing. He said she wasn't doing well at all.
When I asked what was wrong, he stated she had died in February. (I called him in March, upon our return.) I asked what happened and he stated she wasn't doing well and kept loosing weight. He stated he called the vet to check her and the vet said she was an old horse and to just let her die. When I questioned him who the vet was, he indicated it was a local veterinary. When I questioned him further about the vet, he indicated it was actually a friend of his from Wyoming who is a vet and was visiting him. He added that the vet wormed her but it did no good.
He said he went out to feed on the morning of what he "thinks" was February 22, 2006, and found Nitemare lying on the ground. His statement was, "I looked at her and said, oh, no, nitemare, please don't die on me and she lifted her head and whinnied at me then dropped her head and died." I asked him why he never called me to tell me she was sick and he said, "I couldn't find your phone number." I called the vet to ask why he didn't take care of her and his office assistant stated that their office had never been called to the lessee's place and that the only business they did with lessee was to sell lessee worming paste - he wormed his own horses.
I then called the farrier and asked him when the last time was that he saw Nitemare and he said around the end of November. He stated she looked real good and found it hard to believe she died. I also received a message from a family friend of the lessee's who stated the last time she saw Nitemare, the horse looked good but that she hadn't seen Nitemare since sometime in January.
When I asked lessee where he buried my horse, he pointed to a spot along a fence-line and said, "I buried her like all cowboys do, along the trail." I then told him I wanted her at my property and that in the spring, I would come to have her dug up and buried at my place, to which his eyes popped open and he just stared at me.
I called Vermont State Police and spoke with them on the phone but did not fill out a complaint as they said there was nothing they could do legally. I then wrote a letter to them and received a response from the Director of the Vermont State Police. However, it was not an important issue to the police and I could get no assistance. I do have copies of the correspondence.
However, the one thing I remember is that the day I went to lessee's to pick up Nitemare's blanket, I saw a new horse in the barnyard to replace her and now, two years later, suspect she may not have died but was sold or traded for the new horse - and I believe she may be in Vermont. I know she is old now, but she comes from the Cundall Ranch in Wyoming and her siblings are in their 30's and her mother is still alive and is 35 so it gives me hope.
