FOUND - Deceased 9/28/2007 - Marvin - AGED Sorrel & White Paint Gelding Sold without Consent - Sept. 25, 2007 in Perkasie, Pennsylvania

Marvin is confirmed deceased by a rendering plant in Pennsylvania. A lawsuit has been filed and Marvin's owner, Dawn, is asking for help with his legal expenses in her civil suit against the people responsible.

I am holding a beef and beer for Marvin on Nov. 3, 2007, at Penny Gardens Tavern at 8 pm. The cost of the tickets is $25. $15 will go towards Marvin's legal fees and $10 will go to the bar.


As everyone knows, my horse Marvin was [taken illegally] from me and sold to a man who in turn cut him open and [sent him to a rendering plant]. I am trying to legally go against these people.

I have a horse lawyer. She is very nice. Her fee is usually $250 an hour but she is only charging me $175 an hour. Marvin was a 26 year old paint gelding he was my first horse and he meant the world to me. The "human beings" that did this to him deserve to pay and I have given $1000.00 to the lawyer already. I need help with the rest of the money.

Excerpts from the lawsuit regarding allegations: (Defendants names removed and replaced with No. 1, No. 2 and No. 3.)

  • Plaintiff took ownership for Marvin in and about September 2006, which horse was given to her in exchange for valuable consideration.
  • In or about May of 2007, No. 1 and Lathrop entered into a written agreement with Lathrop to memorialize Lathrop's ownership of Marvin.
  • Marvin at all times was represented as owned by Lathrop to all concerned, and was considered to be owned by Lathrop by the Defendants' No. 2 and No. 3.
  • In or about the third week of September, 2007, Lathrop advised No. 1 that she was moving to Dallas, PA, and planned to take Marvin with her.
  • On or about September 19, 2007, Plaintiff came to remove her belongings from No. 1's stables and was told by No. 1 that she was no longer welcome at her stables, and that she could not take Marvin with her.
  • On or about , No. 1 advised Lathrop that No. 1 had removed Marvin from her stable, and assured Lathrop that Marvin had been placed into a pasture and was being well cared for.
  • Upon Lathrop's demand for return of Marvin, No. 1 misrepresented Marvin's whereabouts and would not tell Lathrop where she had delivered him.
  • Upon reasonable information and belief, No. 1 delivered Marvin to Defendant No. 2 on Sunday September 23, 2007 and told him that he could do whatever he wanted to the horse.
  • Upon reasonable information and belief, No. 2 sold Marvin to Defendant No. 3 for $100.00 on Sunday September 23, 2007, and No. 3 picked up the horse and took possession of him.
  • On September 26th and 27th, Lathrop contacted No. 2 and No. 3 on multiple occasions, inquiring into the whereabouts of Marvin. Both No. 2 and No. 3 denied knowing Marvin's whereabouts.
  • On or about September 28th, Plaintiff went with the Pennsylvania State Police to the premises of No. 2 and No. 3, and both defendants further denied to Lathrop and the State Police knowing the whereabouts of Marvin.
  • At all times No. 3 denied knowing No. 2, that he had ever taken possession of a horse from him, or that he knew anything about the missing horse.
  • On September 28th, Lathrop learned that No. 3 had delivered Marvin's dead body to a renderer's facility in Harleysville, PA. Agents at the facility identified Marvin from his photograph and description. Agents also indicated that Marvin had been sliced open.


  • NetPosse also has on file a copy of the agreement between the barn owner and Dawn regarding ownership of Marvin. In it the barn owner is so bold as to outline the deplorable condition in which she received Marvin and how she wanted to ensure he was well cared for the rest of his life. It was what he deserved. Yet, the events and allegations show otherwise. All Dawn wants now is justice for Marvin.
